The ground rules for working with Elyven. Clear scope, fair payments and no surprises, so every project starts on the same page.
Every engagement requires an executed Statement of Work (SOW) detailing specific deliverables, timelines, and budgets.
Any features or services requested outside the active SOW will be treated as “Scope Creep” and billed via an explicit Change Order at Elyven’s current hourly rate.
Billed in milestones as outlined in the SOW. Milestones must be approved and paid before subsequent phases begin.
Paid fully in advance on a monthly recurring basis. Retainer fees are not refundable.
Payments delayed beyond seven (7) business days will result in an immediate suspension of active development or marketing campaigns.
Subject to full and final payment of all outstanding invoices, Elyven transfers 100% ownership of the custom source code, asset designs, and final product configurations to the Client.
Elyven retains the right to display non confidential snapshots, logos, and case studies of the completed work within its professional portfolio unless explicitly restricted via an NDA.
For all performance marketing, SEO, and paid media management campaigns, the Client is exclusively responsible for funding ad networks (e.g., Meta, Google, TikTok Ads) directly via their own credit or debit profiles.
Elyven charges strictly for campaign management, strategy, and asset optimization. Elyven does not guarantee explicit conversion figures or ROI percentages due to unpredictable algorithmic shifts and changing market variables.
Elyven builds scalable infrastructure leveraging leading third party tools, AI tools, agents, chatbots, LLM APIs, and cloud providers (AWS, Azure).
All subscription updates, price increments, API usage overages, or service downtimes caused by these external vendors are outside Elyven’s jurisdiction and remain the financial liability of the Client.
Timely execution of development sprints relies on prompt customer feedback, asset delivery (copy, brand guidelines, credentials), and structural approvals within three (3) business days of request.
Delays on the client’s end automatically extend project launch dates, and prolonged client absence exceeding thirty (30) days can result in project termination with no refund.
Elyven designs and develops applications strictly balancing platform guidelines (Apple App Store & Google Play Policies).
However, the absolute approval, rejection, or structural timeline flags during the validation queue lie under the sovereign review of Apple and Google. Elyven cannot be held legally liable for third party marketplace delays or policy updates.
Elyven stands behind its engineering by offering a complimentary 30 day Post Launch Warranty covering unexpected functional bugs directly originating from Elyven’s developed code.
New feature additions, infrastructure hosting changes, and security auditing patches after this period require an active Maintenance SLA Agreement.
